THE REFORMERY TERMS + CONDITIONS.

PLEASE READ CAREFULLY BEFORE BOOKING ANY CLASSES, APPOINTMENTS, COURSES, WORKSHOPS OR EVENTS WITH US

Please read our Terms and Conditions before signing up for membership on a “monthly” basis, or where you wish to purchase classes, private sessions, courses, events and workshops (“Sessions”) with a “Drop In”, “Class Pass” or “Appointment Pass” credit. Sessions can be held in-person at The Reformery Studio or online as a Livestream hosted by The Reformery.

Please note that different terms and conditions apply depending on if you sign up for membership on a “monthly” basis (Section A below) or if you elect to purchase Sessions by Drop in, Class Pass or Appointment Pass (Section B below). Please also refer to the General Section (Section C below) which applies to everyone who attends any “Session” at The Refomery in-studio or livestream.

In these Terms “we”, ”us”, ”our” means Tendu Training Limited. And “you”, “your”, “yours” means you, the client. “The Reformery” is a trading name of Tendu Training Limited.

IMPORTANT INFORMATION ABOUT DATA PROTECTION: The nature of our business and the provision by us of Sessions to you means that we will collect and process certain of your personal data from time to time. We will only do so in accordance with our Privacy Notice.

A. TERMS AND CONDITIONS – FOR CUSTOMERS WITH, OR WISHING TO, PURCHASE A “MONTHLY MEMBERSHIP”

Please read these Terms carefully before signing up for a “monthly membership”. Please also refer back to these Terms from time to time, as they will continue to apply to your “monthly membership” . By signing up for a “monthly membership” you are confirming that you have read the Terms and agree to be bound by them. Section A of these Terms constitutes a “monthly membership” contract between you and us.

1. INTRODUCTION

All “Sessions” provided at our premises or by us under the The Reformery brand are supplied by Tendu Training Limited, trading as The Reformery, (Registered Office: Studio 512/513 The Green House, The Custard Factory, Birmingham, B9 4DP. Company number: 10360954), subject in each case to the following express Terms.


2. MEMBERSHIP CONTRACT PERIOD

From April 2024, all “monthly membership” contracts will run for an initial 12 month period, excluding any time that the membership is frozen. All “monthly membership” contracts that started on or before October 2023 will be subject to the cancellation process outlined in Section A, clause 11 below as a .

For 12 payments will be debited from your designated card on your BSport account. 

Payment for your “monthly membership” will be on a due on each calendar month on the anniversary of your sign up. 

During your initial 12 month period of your membership, you shall not be entitled to bring this contract to an end. 

At the end of the initial period of your “monthly membership”, your “monthly membership” will automatically rollover to the next month and you will be entitled to : (i) to continue with your “monthly membership” on a rolling monthly basis on the prevailing “monthly membership” fee rate that applies from month to month; or (ii) cancel your contract in accordance with Section A, clause 11 below.

After 6 months you are eligible to freeze your membership for no longer than one calendar month. The membership will re-start at the end of the month, and continue for the remaining time of the active membership.

The time that the membership is frozen for, is excluded from the 12 month terms that the initial contract runs for.

No refunds, partial or otherwise are possible.

3. WHAT’S INCLUDED IN A “MONTHLY MEMBERSHIP”

All Reformer and Mat Pilates group classes are included in the membership.

4. WHAT’S EXCLUDED IN A “MONTHLY MEMBERSHIP”

Community spaces, private 121 or 221 Sessions, Courses, Workshops and Events are excluded from the membership.

5. PAYMENT OF MEMBERSHIP FEES

You will need to create a membership profile on BSport to make payment for your “Monthly Membership” fees and to book any Session.

Your first monthly membership fee payment will be processed on the date you sign up for your membership. Subsequent monthly membership fee payments will be processed via your original payment method on the same day of each calendar month that corresponds to the date which you signed up for membership (or the nearest equivalent day in shorter months (where relevant). This also applies where you have elected to remain on a rolling monthly contract after the end of your fixed term contract period.

On signing up for the Membership, you must add your chosen payment credit or debit card to your BSport account for all future payments.

Your monthly Membership fees will be processed automatically via Stripe, the payment partner of our booking software, BSport.

9. NON-PAYMENT OF MEMBERSHIP FEES

If your membership fees become overdue, we reserve the right to refuse you entry into any Sessions and/or other events until the overdue sums are paid in full. 

All future bookings will be cancelled automatically.

Should you default on payments to us (after we have tried to collect payment twice), you will cease to be a “Monthly Member” and will become a “Drop in” customer until such time as the relevant month's payment is paid. 

We reserve the right to notify any default to a credit reference agency or other third party as part of our efforts to obtain payment from you.

10. MEMBERSHIP FEE CHANGES

We reserve the right to review and change membership fees and Session fees periodically. Once your initial contract period has come to an end, if you choose to continue with your membership (i.e. by continuing on a rolling monthly basis), the monthly membership fee will be charged at the rate prevailing per month for monthly rolling contracts.

11. CANCELLATION OF MEMBERSHIP

If you are a “Monthly Membership” customer, you are only able to terminate your membership at the end of your initial 12 month term (excluding any time where the membership has been frozen). Any “Monthly Membership” that started on or before October 2024 can be cancelled with the notice period set out below.

To terminate your membership, you must give us a minimum of 31 days written notice via e-mail to reception@thereformery.co.uk. 

If you wish to terminate the membership at the conclusion of your initial contract period set out in Section A, clause 2, you must notify us at least 31 days before the end of this initial contract period to ensure that your membership ends and that no further payments are taken.

After the initial term, if you have continued your “Monthly Membership” on a rolling basis, you must give us a minimum of 31 days written notice via e-mail to reception@thereformery.co.uk. If a payment is due within that 31 days notice period, your full monthly payment will be taken and your “Monthly Membership” will be continued until the day before your next payment date.


12. FREEZING YOUR MEMBERSHIP

It is not possible to freeze a “Monthly Membership” during the initial six month of your term. If you want to freeze your membership, you are only able to do so for up to and including a period of one calendar month.

A Membership Freeze can only be activated after the membership renewal date and will be automatically re-activated on the renewal date, one calendar month as agreed with Us, after the initial freeze date.

Members must request a Membership Freeze in writing, one calendar month, or 31 days weeks prior to their payment date to the Membership Team via email at reception@thereformery.co.uk

4. BOOKING SESSIONS

Each Session will be shown clearly on the online timetable. All Sessions included in your chosen membership type (see clause 3, above) will have no cost attributed to them. Session bookings can be made up to 14 days in advance. Bookings can be made only via our software provider BSport. It is your responsibility to ensure that you have made your booking and (where relevant) submitted payment correctly.

5. CHANGING OR CANCELLING YOUR BOOKING AND NO SHOWS.

You may change or cancel your booking for a Session, without charge, up to 24 hours before the start of the Session that you have booked.

If you book onto a Session within 24 hours of its scheduled start time, there is no entitlement to change or cancel.

Any late cancellations or no-shows in any calendar month will be charged at the £23 per session for Memberships.

These resulting additional charges will be made at any point before the end of the following month and processed via your original payment method

6. IF WE CANCEL YOUR BOOKING

In the event that we cancel a Session that you have booked, we will make reasonable efforts to contact you by email or in-app notification to let you know.

7. SESSION BOOKING CONFIRMATION

Your booking of a Session is not complete until you have received a booking confirmation from us & the booking shows in your Reformery BSport member account. Please make sure your booking is confirmed before you attend the Session to avoid disappointment. If you do not receive confirmation, please contact us by e-mail (reception@thereformery.co.uk), please note that we may not be able to respond immediately (see Section C, clause 6.c for details on response time). All Sessions are offered by us subject to availability. We do not guarantee availability of a Session at any time.


B. TERMS AND CONDITIONS – FOR CUSTOMERS WITH, OR WISHING TO, PURCHASE A “MONTHLY PAYG MEMBERSHIP”

Please read these Terms carefully before signing up for a “monthly PAYG membership”. Please also refer back to these Terms from time to time, as they will continue to apply to your “monthly PAYG membership” . By signing up for a “monthly PAYG membership” you are confirming that you have read the Terms and agree to be bound by them. 

A “monthly PAYG membership” can be either an All Class PAYG membership or an Off Peak PAYG membership.

Section B of these Terms constitutes a “monthly PAYG membership” contract between you and us.

1. INTRODUCTION

All “Sessions” provided at our premises or by us under the The Reformery brand are supplied by Tendu Training Limited, trading as The Reformery, (Registered Office: Studio 512/513 The Green House, The Custard Factory, Birmingham, B9 4DP. Company number: 10360954), subject in each case to the following express Terms.

2. MEMBERSHIP CONTRACT PERIOD

Your “monthly PAYG membership” will run for an initial 1 month period. Monthly payments will be debited from your designated card on your BSport account. 

Payment for your “monthly PAYG membership” will be due each calendar month on the anniversary of your sign up. Your “monthly PAYG membership” will automatically rollover to the next month and you will be entitled to : (i) to continue with your “monthly PAYG membership” on a rolling monthly basis on the prevailing “monthly PAYG membership” fee rate that applies from month to month; or (ii) cancel your contract in accordance with Section B, clause 11 below.

You are unable to freeze or hold your “monthly PAYG membership” during the monthly period.

No refunds, partial or otherwise are possible.

3. WHAT’S INCLUDED IN A “MONTHLY PAYG MEMBERSHIP”

All Class “MONTHLY PAYG MEMBERSHIP” : All Reformer and Mat Pilates group classes are included.

Off Peak “MONTHLY PAYG MEMBERSHIP” : All reformer and mat pilates classes between Monday - Friday 9am - 4.30pm, Sunday 4.30pm - 6.30pm

4. WHAT’S EXCLUDED IN A “MONTHLY PAYG MEMBERSHIP”

All Class “MONTHLY PAYG MEMBERSHIP” : Community spaces, Private 121 or 221 Sessions, Courses, Workshops and Events are excluded from the membership.

Off Peak “MONTHLY PAYG MEMBERSHIP” : Community spaces, all classes before 9am & after 4.30pm Monday - Friday, all Saturday classes and Sunday classes before 4.30pm - 6.30pm, private 121 or 221 Sessions, Courses, Workshops and Events are excluded from the membership.


5. PAYMENT OF MEMBERSHIP FEES

You will need to create a membership profile on BSport to make payment for your “Monthly Membership” fees and to book any Session.

Your first monthly membership fee payment will be processed on the date you sign up for your membership. Your subsequent monthly PAYG membership fee payments will be processed via your original payment method on the same day of each calendar month that corresponds to the date which you signed up for membership (or the nearest equivalent day in shorter months (where relevant). This also applies where you have elected to remain on a rolling monthly contract after the end of your initial contract period.

9. NON-PAYMENT OF MEMBERSHIP FEES

All future bookings will be cancelled automatically.

We reserve the right to notify any default to a credit reference agency or other third party as part of our efforts to obtain payment from you.


10. MEMBERSHIP FEE CHANGES

We reserve the right to review and change membership fees and Session fees periodically. Once your initial contract period has come to an end, if you choose to continue with your membership (i.e. by continuing on a rolling monthly basis), the monthly membership fee will be charged at the rate prevailing per month for monthly rolling contracts.


11. CANCELLATION OF MEMBERSHIP

If you are a “Monthly PAYG Membership” customer, you are only able to terminate your membership 10 working days before the next billing period. To terminate your membership, you must give us a minimum of 10 working days written notice via e-mail to reception@thereformery.co.uk. If you wish to terminate the membership at the conclusion of your initial contract period set out in Section A, clause 2, you must notify us at least 10 working days before the end of this initial contract period to ensure that your membership ends and that no further payments are taken.


12. FREEZING YOUR MEMBERSHIP

It is not possible to freeze a “Monthly PAYG Membership”. If you wish to stop your payments, please email us 10 working days before the next payment is due and we will cancel your membership.

4. BOOKING SESSIONS

Each Session will be shown clearly on the online timetable. All Sessions included in your chosen membership type (see clause 3, above) will have no cost attributed to them. Session bookings can be made up to 14 days in advance. 

Bookings can be made only via our software provider BSport. It is your responsibility to ensure that you have made your booking and (where relevant) submitted payment correctly.

5. CHANGING OR CANCELLING YOUR BOOKING AND NO SHOWS.

You may change or cancel your booking for a Session, without charge, no later than 24 hours before the start of the Session that you have booked.

If you book onto a Session within 24 hours of its scheduled start time, there is no entitlement to change or cancel.

Any late cancellations or no-shows in any calendar month will be charged at the current full drop-in rate (currently £23) per session.

These resulting additional charges will be made at any point before the end of the following month and processed via your original payment method.


6. IF WE CANCEL YOUR BOOKING

In the event that we cancel a Session that you have booked, we will make reasonable efforts to contact you by email or in-app notification to let you know.


7. SESSION BOOKING CONFIRMATION

C. TERMS AND CONDITIONS – FOR CUSTOMERS WISHING TO BECOME A MEMBER VIA “DROP IN”, “CLASS PASS” OR “APPOINTMENT PASS”

Please read these Terms carefully before proceeding. By making a payment of a “DROP IN”, "CLASS PASS” OR  “APPOINTMENT PASS” you are confirming you have read the Terms and agree to be bound by them.

1. INTRODUCTION

All Sessions provided at our premises or by us under the The Reformery brand are supplied by Tendu Training Limited, trading as The Reformery, (Registered Office: Studio 512/513 The Green House, The Custard Factory, Birmingham, B9 4DP. Company number: 10360954), subject in each case to the following express Terms.

2. “DROP IN”, "CLASS PASS” OR  “APPOINTMENT PASS”

You are bound by Section C of these Terms from the date on which you make a payment to attend a Session until such time as you cease your attendance or your passes expire.

“DROP IN” : this is a full priced credit for any Session.

"CLASS PASS BUNDLE” : this is a bulk purchase of class credits which contain a discount.

“APPOINTMENT PASS” : this is a purchase for (a) credit(s) to a private session.

3. “DROP IN”, "CLASS PASS BUNDLE” OR  “APPOINTMENT PASS” EXPIRY DATES

All  “Drop In”, "Class Pass Bundle” Or  “Appointment Pass” credits have an expiry date. These can be extended at an additional price of £15 per week from the date of expiry. There are no exceptions to this rule.

4. BOOKING SESSIONS

Each Session will be shown clearly on the online timetable. You will need to create a Reformery membership profile on BSport to book any Session. Bookings for Sessions can be made up to 14 days in advance. Bookings can be made only via our software provider BSport. It is your responsibility to ensure that you have made your booking and (where relevant) submitted payment correctly. Booking Appointments will be completed on request via reception@thereformery.co.uk.

5. PAYMENT for “DROP IN”, "CLASS PASS” OR  “APPOINTMENT PASS”

You can pay for Sessions via the “DROP IN”, "CLASS PASS” OR  “APPOINTMENT PASS” options shown in your Reformery BSport account. Payment for your Sessions may be made by credit card or debit card. Payments can be made online via your Reformery BSport account only. In exceptional circumstances, we can take card payments on The Reformery premises.

6. SESSION FEE CHANGES

We reserve the right to review and change Session fees periodically. The prices will be reflected on purchase of a new “drop in”, "class pass” or  “appointment pass”. All existing  “drop in”, "class pass” or  “appointment pass” credits are valid until expiry.

7. SESSION BOOKING CONFIRMATION

Your booking of a Session is not complete until you have received a booking confirmation from us & the booking shows in your Reformery BSport member account. Please make sure your booking is confirmed before you attend the Session to avoid disappointment. Your session will show on your group or appointment bookings section on your Reformery BSport account. If you do not receive confirmation, you can contact us by e-mail (reception@thereformery.co.uk), however, please note that we may not be able to respond immediately (see Section C, clause 6.c for details on email response time). All Sessions are offered by us subject to availability. We do not guarantee availability for a Session at any time.

8. IF WE CANCEL YOUR BOOKING

In the event that we cancel a Session that you have booked, we will make reasonable efforts to contact you by email or in-app notification to let you know.

9. PRE-PAID “CLASS PASS” PACKS AND PROMOTIONAL PURCHASES

“Class Pass” Bundles are pre-paid bundles of Session types that give the customer a bulk discount at the point of purchase. Pre-paid “Class Pass” Bundles and promotional purchases are only applicable against the applicable Session type and the applicable Session genres at the point of purchase and cannot be swapped or exchanged at any time. “Class Pass” Bundles and promotional purchases cannot be exchanged for any other service or product that we offer. “Class Pass” Bundles and promotional purchases are non-refundable. “Class Pass” Bundles and promotional purchases have an expiry date, these may be extended at an additional price of £10 per week from the date of expiry. There are no exceptions to this rule.

10. “INTRO” OFFER OR “PRIVATE INTRO SESSION”

The “Intro”, and “Private Intro session” offers are limited to one purchase per customer and may only be purchased once. We reserve the right to not fulfil any future bookings made by any customer found to have abused, misused or gained an unfair advantage in respect of the Promotion. The rules for “Late Cancellation” and “No-Show” apply. (Section D, clause 1). The expiry date for the “Intro” and “Private Intro session” offers can not be extended. There are no exceptions to this rule.

11.  “ONE MONTH UNLIMITED” INTRO OFFER

“One Month Unlimited” offer is limited to one purchase per customer and may only be purchased once. We reserve the right to not fulfil any future bookings made by any customer found to have abused, misused or gained an unfair advantage in respect of the Promotion. You will be asked to add a payment card to your account on purchase. The rules for “Late Cancellation” and “No-Show” apply. (Section D, clause 1).

WHAT’S INCLUDED IN A  “ONE MONTH UNLIMITED”:

All Reformer and Mat Pilates Sessions are included in the “One Month Unlimited”.

WHAT’S EXCLUDED IN A “ONE MONTH UNLIMITED” INTRO OFFER:

Community spaces, private Sessions, Pre-natal Sessions, Post-Natal Sessions, Courses, Workshops and Events are excluded from the “One Month Unlimited”.


12. “SUMMER MONTHLY CLASS PASS” OFFER

“Summer Monthly Class Pass” offer is limited to up to one purchase per customer per calendar month from July 4th, 2023 to Sept 15th, 2023. With a maximum of 3 bookings per customer within the date range.

The pass can be re-purchased again on the monthly anniversary of the first purchase.

We reserve the right to not fulfil any future bookings made by any customer found to have abused, misused or gained an unfair advantage in respect of the Promotion. You will be asked to add a payment card to your account on purchase. The rules for “Late Cancellation” and “No-Show” apply. (Section C, clause 1).

WHAT’S INCLUDED IN A  “SUMMER MONTHLY CLASS PASS”:

Any Reformer and Mat Pilates Sessions that start no earlier than 9am and finish at 17.30 Monday - Friday are included in the “Summer Monthly Class Pass”. Including the Pre & Post natal week day classes. 

WHAT’S EXCLUDED IN A “SUMMER MONTHLY CLASS PASS” OFFER:

Reformer & Mat Pilates classes starting before 0900 and after 1730 hrs are excluded as are Private Sessions, Courses, Workshops and Events excluded from the “Summer Monthly Class Pass”.

First possible date of purchase is 4th July 2023, last date of purchase is 15th September 2023. No extensions are allowed nor is the pass transferable. 


SECTION D : GENERAL TERMS AND CONDITIONS.

These are applicable to all customers of the Reformery, who hold a “MONTHLY MEMBERSHIP”, “MONTHLY PAYG MEMBERSHIP” or who are  a member via “DROP IN”, “INTRO OFFER”,  “ONE MONTH UNLIMITED”, “CLASS PASS BUNDLE”, “SUMMER MONTHLY CLASS PASS” or “APPOINTMENT PASS”, or who attend a workshop, course or event, in-studio or Livestream.

1. CHANGING OR CANCELLING YOUR BOOKING, AND NO SHOWS.

You may change or cancel your booking for a Session, without charge, up to 24 hours before the start of the Session that you have booked. You can cancel your Session via your account on BSport or through the Reformery App. Your online account will be automatically credited with the cancelled Session credit and you can book any such Session re-credited to your account in accordance with the provisions of these Terms.

If you book onto a Session within 24 hours of its scheduled start time, there is no entitlement to change or cancel.

Late Cancellation or No Shows - a Late Cancellation is a cancellation of a session within 24 hours of your Session start time. A No-Show is not attending your Session without cancellation.

Late Cancellation or No Shows (“Drop-In”, “Class Pass” or Appointment Pass” members): One Session credit will be deducted for Late Cancellations or No-Shows for any Sessions paid for by “Drop-In”, “Class Pass” or “Appointment Pass” members.

Late Cancellation or No Shows (“Monthly Membership”, “Monthly PAYG Membership”, “Summer Monthly Class Pass” & “One Month Unlimited” offer): Any Late Cancellations or No-Shows will be charged at the rate of a “Drop-In” or £23 per session, for “Monthly Membership”, “Monthly PAYG Membership”, “Summer Monthly Class Pass” & “One Month Unlimited” offer customers. These resulting additional penalty charges will be made at any point before the end of the following month and processed via your original payment method.

Non-Payment of Penalty Fees : “Monthly Membership”, “Monthly PAYG Membership”, “Summer Monthly Class Pass” or “One Month Unlimited” members, your pass will be immediately withdrawn if penalty fees cannot be taken automatically from the account due to an incorrect card or no card details.The member will be refused access to any Sessions. Members will have to purchase a “Drop-In” or “Class Pass” Bundle to book any further sessions until payment is made.

2. LATENESS POLICY

Group Sessions: We operate a strict Lateness Policy which prevents you taking part in a Session if you arrive once the class has started. If you arrive more than 2 minutes late for the relevant Session, in such situations you will be deemed to be “Late”. This policy is in place to prevent injury and to be mindful of the teacher and other participants in the Session. If you are deemed “Late” then you will be charged a credit as if you attended the session or be administered with a “No-Show” penalty if you hold a “Monthly Membership”, “Monthly PAYG Membership”, “Summer Class Pass” or “One Month Unlimited” offer. 

Private Sessions: if you are more than 30 minutes late, without acknowledged written notice to the instructor, the same rule applies. In line with our cancellation policy, you will not be refunded for Sessions you are unable to attend because you are Late.

3. PRE-NATAL POLICY

As soon as a member knows she is pregnant, they must inform us immediately by email to reception@thereformery.co.uk and pause any classes until 12 weeks. 

After 12 weeks;

Regular Reformery clients can attend classes as advised by the Management team at The Reformery until 20 weeks.

Regular Reformery clients must start pre-natal classes at 20 weeks

New clients must start at the pre-natal classes, post 12 weeks.

4. POST-NATAL POLICY

New or Returning clients, must advise us if they have recently had a baby, we require our clients to attend post-natal classes from 8 weeks post partum, or 11 weeks C-Section. All clients must have been signed off to exercise by their Doctor or Midwife.

Due to space, any babies attending class must be carried in a sling basket. No buggies are allowed in the studio for class due to space reasons.

Please email us at reception@thereformery.co.uk with any pre/post-natal enquiries so we can guide you to the correct class.

5. FILMING POLICY:

At The Reformery we have a ‘No Filming During Class' policy. 

With the teachers agreement, you can take pictures of the studio before or after class (excluding any other clients, unless you have their individual permission).

 During class, we ask you to refrain from doing any filming during class, not only is this distracting for the teachers, unfair on other clients and an infringement on their personal privacy, it can pose a health and safety risk for you too.

 Anyone who is filming will be asked to stop, immediately. 

If you wish to film yourself doing pilates for social media or any other purposes, please get in touch with us and you can book in a private session with one of our teachers and film what you would like to film during that session. 

6. PROMOTIONAL OFFERS

From time to time we may run various promotions, prize draws and other offers (“Promotions”). We may implement separate terms and conditions in respect of any such Promotion, and will advise you accordingly where this is the case. However, notwithstanding this:

We reserve the right to end any promotion without warning at any time.

We also reserve the right to withdraw your right to any Promotion if we consider, in our absolute discretion, that you have abused, misused or gained an unfair advantage in respect of the Promotion. Misuse includes, but is not limited to, the creation of multiple customer accounts and self-referral.

Additionally, we reserve the right to not fulfil any future bookings made by any customer found to have abused, misused or gained an unfair advantage in respect of the Promotion. Any prizes offered by us in connection with a Promotion must be claimed within 21 days of announcement of the winners. We have 45 days to issue any such prize. We reserve the right to substitute any prize or promotion for the equivalent value in Sessions.

7. HOW WE CAN CONTACT EACH OTHER

By you: Any written notice or enquiry / feedback should be e-mailed to reception@thereformery.co.uk. You may change or cancel a Session online only through your online BSport account or Reformery app.

By us: We may contact you using any of the contact details you provide to us when you sign up for membership, which may include via telephone or text message. Our Privacy Notice sets out how we may process your personal data, which includes the contact details you provide to us.

Time elapse of communication between Us and You. We have a micro administration team and therefore any email will be responded to within 48 hrs of receipt. You can take all immediate and urgent actions required for Sessions through your Reformery BSport members account. With anything else, we will be in touch and endeavour to support you in the best way possible within the 48hr window, or before.

8. LIABILITY

We not are responsible for any loss or damage that you suffer at or around the studio.,We are not responsible for any loss or damage caused by us or any of our freelance staff or those hiring our premises, or for loss or damage which is your own fault or which is attributed to a third party unconnected with the provision of our services.

Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we accepted your order.

We do not in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or for any breach of any terms implied by law.

9. FORCE MAJEURE

We shall not be liable to you or deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms if the delay was due to any cause beyond our reasonable control, including, but not limited to, acts of god, terrorism, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T. system failures, viruses, difficulties in obtaining raw materials, labour , fuel, parts or machinery, power failure or breakdown in machinery.

10. WAIVER

No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver, to be effective, must be in writing.

111. SEVERABILITY

If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

12. ENTIRE AGREEMENT

These Terms together with our disclaimer and any policies we have in force from time to time constitute the entire agreement between us and you and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between us and you.

13. THIRD PARTY RIGHTS

These Terms constitute a contract between you and us. No other person shall have the right to enforce any of these Terms.

14. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with English law and the parties hereby agree to submit the exclusive jurisdiction of the English courts.
